1. Introduction
These Terms of Use and Client Agreement (“Terms”) govern all bookings, services, communications, and interactions between ZenTouch (“Company”, “Provider”, “Therapist”) and any client (“Client”).
By booking, purchasing, or receiving services from ZenTouch, the Client confirms that they have read, understood, and accepted these Terms in full.
2. Business Structure
ZenTouch operates as an independent international mobile wellness business under Georgian Individual Entrepreneur (IE) status with Small Business taxation regime.
ZenTouch is not a medical clinic, healthcare institution, physiotherapy practice, or incorporated company.
All services are provided independently by the business owner and/or authorized independent wellness professionals.
3. Services
ZenTouch provides premium international mobile wellness services, including but not limited to:
- Therapeutic massage
- Relaxation massage
- Aromatherapy wellness rituals
- Luxury in-villa and hotel wellness experiences
- International wellness residencies
- Multi-day wellness programs
- Private mobile treatments
Services are strictly professional wellness services and are not intended as medical treatment, diagnosis, psychotherapy, physiotherapy, or sexual services.
4. International Operations & Residencies
ZenTouch operates internationally and may temporarily offer services through:
- 3–4 week wellness residencies
- Seasonal operations
- Hotel collaborations
- Retreats
- Luxury villa partnerships
- Mobile wellness events
Availability, pricing, operational procedures, accepted payment methods, and schedules may vary depending on the country or jurisdiction.
The Client acknowledges that international travel logistics may occasionally affect scheduling flexibility.
5. Bookings & Payments
All appointments remain subject to availability and written confirmation.
Full payment is due before the session.
Advance payment may be mandatory for international bookings, residency programs, VIP bookings, last-minute reservations, group bookings, and concierge arrangements.
No booking is considered confirmed until payment has been received and acknowledged.
6. Cancellation Policy
Cancellations made less than 24 hours before the appointment may be charged in full.
For international residencies or reserved wellness programs, deposits may be non-refundable and travel-related operational costs may remain payable.
7. Client Conduct & Professional Boundaries
ZenTouch maintains a strict professional wellness environment.
The following are strictly prohibited:
- Sexual requests or propositions
- Inappropriate touching
- Harassment
- Aggressive conduct
- Intoxicated behavior
- Illegal activity
- Unauthorized recording or photography
Any inappropriate behavior results in immediate termination of the session without refund.
ZenTouch reserves the right to refuse future service at its sole discretion.
8. Health Disclosure
Clients must disclose relevant injuries, allergies, medical conditions, pregnancy, recent surgeries, or physical limitations before treatment.
ZenTouch reserves the right to refuse treatment where health or safety concerns arise.
9. Liability Limitation
To the maximum extent permitted by law, ZenTouch shall not be liable for indirect damages, travel disruptions, allergic reactions, undisclosed medical conditions, or third-party venue restrictions.
Total liability shall never exceed the amount paid for the relevant service.
10. Hotel, Villa & Third-Party Locations
The Client is responsible for obtaining authorization where required and ensuring a safe environment for treatments.
ZenTouch bears no responsibility for venue restrictions, third-party conduct, building policies, or external security issues.
11. Intellectual Property
All branding, visuals, treatment concepts, website content, logos, marketing materials, and business concepts remain the exclusive property of ZenTouch.
12. NDA & Confidentiality Clause
Both ZenTouch and the Client agree to maintain strict confidentiality regarding personal information, booking details, treatment details, residences, hotels, private conversations, and travel schedules.
13. Mobile Outcall Security Clause
ZenTouch reserves the right to refuse bookings, request identity verification, require advance payment, refuse unsafe environments, and terminate services immediately where safety concerns arise.
14. Chargeback Protection Clause
Fraudulent chargebacks, false payment disputes, or abusive refund claims may result in debt recovery procedures, legal action, and banking dispute evidence submission.
16. Non-Defamation Clause
The Client agrees not to knowingly publish or distribute false statements, malicious accusations, defamatory content, or misleading claims intended to damage the reputation or operations of ZenTouch.
17. Arbitration & Dispute Resolution
Before initiating formal litigation, both parties agree to first attempt good-faith resolution through private negotiation.
18. Governing Law & Jurisdiction
These Terms shall be governed by the laws of Georgia.
19. Right to Refuse Service
ZenTouch reserves the unrestricted right to refuse bookings, cancel appointments, decline collaborations, or terminate sessions where necessary to protect safety, reputation, legal compliance, professional standards, and operational integrity.
20. Acceptance of Terms
By booking or receiving services, the Client confirms that they are at least 18 years old, have read and accepted these Terms, understand the professional nature of the services, and agree to comply with all operational requirements.
